Terms of Service

These Terms of Service ("Terms") govern your use of YeeHaul ("we," "us," "our"), the dumpster rental marketplace at yeehaul.app. By using YeeHaul, you agree to these Terms. If you do not agree, do not use the platform.


1. What YeeHaul Is

YeeHaul is a marketplace that connects customers who need dumpster rentals with independent hauling companies ("haulers") who provide them. We are not a hauler. We do not own, operate, or dispatch dumpsters. When you book a dumpster through YeeHaul, you are entering into a service agreement with the hauler, not with us.

Our role is to make the booking process simple and transparent: you can compare haulers, see real prices, and book online. The hauler delivers the dumpster, picks it up, and handles disposal.


2. Accounts

Creating an Account

You may need to create an account to book a dumpster or claim a hauler listing. You agree to provide accurate information and keep it current. You are responsible for maintaining the security of your account credentials.

Hauler Claims

Haulers can claim their directory listing on YeeHaul. Claiming verifies that you are authorized to represent the business. Once claimed, you can manage your pricing, service area, container inventory, and booking settings.

Account Termination

You can close your account at any time by emailing hello@yeehaul.app. We may suspend or terminate accounts that violate these Terms, engage in fraud, or fail to meet platform standards.


3. Customer Responsibilities

As a customer using YeeHaul, you agree to:

  • Provide accurate booking information. Delivery address, project type, waste type, and scheduling details must be truthful and complete.
  • Prepare the delivery site. Ensure the placement area is accessible and clear. Haulers may charge additional fees or reschedule if the site is not accessible.
  • Follow waste restrictions. Do not place prohibited materials in the dumpster. This includes hazardous waste, tires, batteries, appliances with refrigerant, and other restricted items. Specific restrictions vary by hauler and local regulations.
  • Pay for services. Payment is due at the time of booking. Additional charges (overage fees, extended rental fees) are billed according to the hauler's stated pricing.
  • Communicate directly with the hauler for scheduling changes, special requests, or issues during the rental period.

4. Hauler Responsibilities

As a hauler on YeeHaul, you agree to:

  • Provide accurate information. Pricing, service area, container sizes, waste stream availability, and rental terms must be truthful and current.
  • Fulfill bookings. Deliver and pick up dumpsters according to the agreed schedule. Communicate promptly with customers about any delays or changes.
  • Maintain service quality. Respond to customer inquiries within a reasonable timeframe. Resolve disputes professionally.
  • Comply with all applicable laws. Licensing, insurance, permitting, weight limits, disposal regulations, and environmental requirements in your service area.
  • Keep your listing current. Update pricing, availability, and service area as they change. Outdated listings that result in customer complaints may lead to listing suspension.

5. Commission and Fees

Booking Commission

YeeHaul charges a 10% commission on completed bookings made through the platform. The commission is calculated on the total booking amount, including base rental price and included tonnage. Overage charges billed after the rental are also subject to commission.

Subscription Fees

Haulers may optionally subscribe to YeeHaul's platform tools for $39 per month. The subscription includes a hosted website, AI phone agent, dedicated phone number, online booking capabilities, and Google Business Profile integration. The subscription can be canceled at any time.

Free Tier

Claiming a hauler listing is free. Free listings include a directory presence and a quote request form. No payment information is required to claim a listing.


6. Payments

Payment Processing

All payments are processed through Stripe. By making or receiving payments through YeeHaul, you agree to Stripe's terms of service. YeeHaul does not store credit card numbers or bank account details.

Haulers receiving payments connect their bank account through Stripe Connect. Booking payments are collected from the customer and transferred to the hauler minus YeeHaul's commission.

Refunds

Refund policies are set by individual haulers and displayed on their listing at the time of booking. Common terms include:

  • Cancellation before delivery: Eligible for a full refund per the hauler's cancellation policy.
  • Cancellation after delivery: Refunds are at the hauler's discretion and may be partial.
  • Disputes: If a hauler does not deliver as agreed, contact us at hello@yeehaul.app. We will work with both parties to reach a resolution.

YeeHaul does not guarantee refunds. We facilitate communication between customers and haulers but the service agreement is between those two parties.


7. SMS Communications

Consent

By opting in to SMS communications on YeeHaul, you consent to receive text messages related to your use of the platform. Message types include:

For haulers: Lead notifications, booking updates, and account alerts.

For customers: Delivery notifications, pickup reminders, and rental updates.

Frequency

Message frequency varies based on account activity.

Opting Out

You can opt out at any time by replying STOP to any message. After opting out, you will receive a one-time confirmation and no further messages from that number.

Data Rates

Message and data rates may apply. Contact your wireless carrier for details.

Consent Is Not Required

Consent to receive SMS messages is not a condition of purchasing any service, booking a dumpster, or claiming a listing on YeeHaul.

8. Intellectual Property

YeeHaul's Property

The YeeHaul name, logo, design, and platform software are our property or licensed to us. You may not copy, modify, distribute, or create derivative works from any part of the platform without written permission.

Your Content

When you submit content to YeeHaul (business descriptions, photos, reviews), you retain ownership but grant us a non-exclusive, royalty-free license to display, distribute, and use that content in connection with operating the marketplace. This license ends when you delete the content or close your account.

Hauler Listings

Directory listings are based on publicly available business information. Claiming a listing gives you control over your profile content but does not grant ownership of the listing itself. Unclaimed listings remain on the platform as public directory information.


9. Prohibited Conduct

You agree not to:

  • Use YeeHaul for any unlawful purpose.
  • Misrepresent your identity, business, or pricing.
  • Post false reviews or manipulate ratings.
  • Interfere with the platform's operation or security.
  • Scrape, crawl, or collect data from the platform by automated means without written permission.
  • Circumvent the platform to avoid commission payments on bookings that originated through YeeHaul.
  • Harass, threaten, or abuse other users.
  • Use another user's account without authorization.

Violation of these rules may result in immediate account suspension or termination.


10. Limitation of Liability

YeeHaul is a marketplace. We connect customers with haulers but we do not provide hauling services ourselves.

To the fullest extent permitted by law:

  • YeeHaul is not liable for the quality, safety, legality, or timeliness of hauling services provided by haulers.
  • YeeHaul is not liable for damages arising from interactions between customers and haulers, including property damage, injury, delays, or disputes.
  • YeeHaul's total liability to you for any claim arising from your use of the platform is limited to the amount you paid to YeeHaul (not to the hauler) in the 12 months preceding the claim.
  • YeeHaul is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, regardless of the theory of liability.

Some jurisdictions do not allow limitations on liability. In those cases, our liability is limited to the greatest extent permitted by law.


11. Indemnification

You agree to indemnify and hold harmless YeeHaul, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the platform.
  • Your violation of these Terms.
  • Your violation of any law or regulation.
  • Any content you submit to the platform.
  • Any dispute between you and another user.

12. Dispute Resolution

Informal Resolution First

Before filing a formal claim, you agree to contact us at hello@yeehaul.app and attempt to resolve the dispute informally. We will work with you in good faith to find a resolution within 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, you and YeeHaul agree to resolve it through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Arbitration will take place in Austin, Texas, unless both parties agree to a different location or virtual proceedings.

Class Action Waiver

You agree to resolve disputes with YeeHaul on an individual basis. You waive any right to participate in a class action, class arbitration, or representative proceeding.

Small Claims Exception

Either party may bring a qualifying claim in small claims court in Travis County, Texas, as an alternative to arbitration.


13. Termination

We may suspend or terminate your access to YeeHaul at any time, with or without cause, with or without notice. Reasons for termination include but are not limited to:

  • Violation of these Terms.
  • Fraudulent activity.
  • Failure to meet platform quality standards (haulers).
  • Extended inactivity.

Upon termination, your right to use the platform ends immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Dispute Resolution) will continue to apply.


14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any legal proceedings not subject to arbitration will be brought in the state or federal courts located in Travis County, Texas.


15. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. For significant changes, we will notify you by email or through a notice on the platform.

Your continued use of YeeHaul after changes are posted means you accept the updated Terms. If you do not agree to the updated Terms, stop using the platform.


16. General Provisions

  • Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and YeeHaul regarding your use of the platform.
  • Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
  • Waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision.
  • Assignment. You may not assign your rights under these Terms. We may assign our rights to a successor or affiliate.
